(Returning to his unit after 6 days' special leave awarded for the part he had played in the recent successful flight over Heligoland).

WIDOW’S CLAIM FAILS
An action in which Mrs. Edith Joan Marriott, of Upheld, Croydon, claimed damages against Mr. Leslie Stuart James Ward,
, of Daneways, Claremont Avenue, Sunbury, in respect of the
death of her husband, was dismissed in the High Court last week. The case for Mrs. Marriott was that her husband
Mr. Edwin Arthur Marriott, aged 39, was walking in Uxbridge Road, Hillingdon Hill, Uxbiidge,
when a lorry driven by Mr. Ward collided with him, and he received fatal injuries.
Defendant denied driving negligently, and contended that the accident was caused by negligence on
Mr. Marriott’s part. Mr. Justice Atkinson said the accident occurred at night on September 12th, 1939. H
e thought that Mr. Ward, an experienced driver, was negligent in not having his headlights on, as he was permitted by law to do at that time,
and in not hooting. Mr Marriott was walking along the road and, in the Judge’s view, he could not
have been keeping any look-out. IIn the circumstances it was Impossible to say that he did not contribute'to the accident, and the Court was therefore bound
by law to find that Mr. Ward Was entitled to succeed.
